Seminar Tidbit: FDA "Laboratory and Submission" Summary

When food or food-related products are detained without physical examination (DWPE) by the Food and Drug Administration (FDA), a third-party laboratory is reached to perform proper, ethical, and accurate testing to help move those products forward and past the FDA’s red-tape. Anresco Laboratories presented at the Customs Brokers & Forwarders of Northern California (CBFANC) in late June, helping a room full of Customs Brokers, Importers, Forwarders and others to understand the laboratory’s role when detained products require analysis.
 
Having worked closely with FDA compliance officers for more than 30+ years at Anresco, NgaLy Frank offered her expertise on sampling, submitting and handling of products for the various approved methods Anresco performs every day. Our goal is to help clients understand the process, provide tips to save time, money, and energy when their products are DWPE.
 
The seminar included a brief description of Anresco’s analytical capabilities ranging from chemical, microbiological and microscopic processes. Our senior Lab Analysts also have more than 30+ years of experience working at Anresco, equipped with the latest instruments laboratories are using worldwide. 
 
Anresco’s food consultant, Dr. Nari Nayini elaborated on the Foreign Supplier Verification Program (FSVP), providing a detailed background on proper handling and HACCP procedures the FDA requires.

Port CES situation: As of July 16, 2018, PCC Logistics opened as interim CES at Oakland. As last reported, CBP revisited CES sites to restore full CES operations at the port.   CBFANC welcomes CBP’s tentative selection for and grateful to PCC Logistics being able to start up operations quickly.  Please know, as CBP protocol, all CES are on interim basis pending full approval upon fulfillment of CES requisites.

Cyber Attack:  July 23, 2018 COSCO suffered a cyber-attackto their operations in the Americas. Global operations was not affected.  This was a second cyber-attack on a major carrier, last year’s Maersk ransomware attack.  COSCO reverted to emails and other work-arounds to facilitate bookings and delivery process.   The cyber-attacks serves reminder for all companies to secure their supply chain processes.
 
CF7512 Inbonds:  Did you know CF7512 are now completely paperless?   Published in Federal Register dated September 28, 2017, the final rule effected November 27, 2017 notified for paperless CF7512 in-bonds by July 2018. 
 
Following information is from San Francisco CBP Port In-bond Coordinator/Post Audit Team:
 
July 2, 2018- Paper CBP Form 7512 will no longer be accepted by CBP for input into ACE. Electronic filing of new in-bond transactions will be the responsibility of the trade. Paper forms or other paper alternatives (screen prints or plain paper documents etc.) will be accepted as part of enforcement processes or verification/audit operations such as warehouse withdrawals, FTZ exports and transfers or vessel/aircraft supply operations where additional information is required on paper forms that is not provided for electronically.
 
August 6, 2018- Electronic reporting of all transactions will be mandatory; CBP will no longer accept paper copies of the CBPF 7512 to perform arrival and export functionality. These functions will be the requirement of the carrier. Electronic reporting will be mandatory. In addition, electronic reporting  of diversion to a port other than reported on the original in-bond will be required. An ACE edit will reject if not performed. Electronic reporting of bonded cargo location (FIRMS code) will be required. An ACE edit will reject arrival if not provided.
 
At this time , no date is set for implementation of the provision requiring the 6 digit Harmonized Tariff Schedule number requirement for Immediate Transportation movement.
 
You don’t need to send Alameda Trade In-Bond Team the paper 7512, but should keep a copy in your file for audit purposes (print screen is acceptable .)

Historically the CF7512 has served many functions.  The main inbond authorizations are for Immediate Transportation (I.T. 61); Immediate Export (I.E. 63); Transportation and Exportation (T.E. 62).   Inbonds also transfer goods with port (technically a Permit to Transfer under a CHL drayage).  Additionally, the CF7512 also serves for Proof of Export on FDA refused goods, USDA non-admissible goods, ship spares and catering supplies.   The new requirement for paperless requires electronic inbonds through ACE as well as requiring arrival (and closure) for the inbonds in ACE.  Bonded carriers are ultimately responsible for the closure of inbonds but the inbond filer (Customs broker, forwarder, or carrier agent) may may not know their role in closure of inbonds.  CBFANC is working with CBP for a trade outreach on inbonds issue.

WESCCON 2018 Scholarship Application

The Pacific Coast Council of Customs Brokers & Freight Forwarders Associations (PCC) and Avalon Risk Management are offering five (5) scholarships to attend WESCCON 2018 in Palm Springs, CA on October 18-21. This is the 11th year that the scholarship has been offered to promote education and industry involvement. The scholarship funds provided by Avalon will be used to cover the cost of coach airfare (if traveling by air) and 3 nights of accommodations at the Loews Coronado Bay. The PCC will waive the conference registration fee for scholarship recipients.
 
Each of the five PCC member associations (San Diego, Los Angeles, Northern California, Columbia River and Washington State) will select one qualified applicant for the scholarship award.  If a member association is unable to select a qualified applicant another recipient will be chosen by the WESCCON General Chair and the PCC President from the pool of applicants received by the other four associations. 
 
Candidates must have a minimum of 2 years experience in the logistics industry.  Applications must be completed and submitted to your local association president on or before August 3, 2018 for consideration. All grant recipients must agree to submit a written summary by November 1, 2018 summarizing their experience at WESCCON and explaining how their attendance will benefit them and further their career goals.
